These Terms of Service ("Terms") govern your use of the software application Rate ("Application", "App") for iOS mobile devices, created by Hit Space LTD ("we", "us", "our"). The Application provides users with earnings calculations related to working under APA (Advertising Producers' Association) guidelines suggested terms.

By accessing or using the Application, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Application.

1. Nature of the Application

Rate is a reference and estimation tool only. While we take care to ensure calculations are accurate based on published APA guidelines, we strongly suggest users verify all calculations against the published APA guidelines themselves.

You acknowledge and agree that:

All calculations provided by the Application are for reference purposes only and should not be relied upon as the sole basis for invoicing, payroll, or any financial decision.
It is your responsibility to verify all calculations before using them for invoicing or any other purpose.
We do not accept responsibility for calculation errors, discrepancies, or any financial loss arising from reliance on the Application's output.
We are not associated with, affiliated with, or endorsed by the APA. The APA guidelines referenced in the Application are interpreted in good faith but may not reflect the most current terms at all times.

2. Account and Data

To use certain features of the Application, you may create an account using your email address, name, and selected crew grade. You are responsible for maintaining the security of your account.

Your calculation data may be stored on your device and on our servers, depending on the features you use. For full details on how your data is collected, stored, and processed, please refer to our Privacy Policy. You can delete your account and associated data through the Application's settings.

3. Subscription and Payment

The Application requires an active subscription to access its features. By using the Application, you agree to the following:

(a) Payment Terms

Subscriptions are available on a monthly or annual basis. All fees are payable in advance through your Apple ID account via the App Store. Subscriptions auto-renew at the end of each billing period unless cancelled. All purchases are processed by Apple and are subject to the App Store terms of service.

(b) Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of your current billing period — you will retain access to the Application until then. No refunds are provided for partial billing periods. It is your responsibility to cancel your subscription if you no longer wish to use the Application, regardless of whether you actively use it.

We may change the subscription price at any time. Any price change will take effect at the start of the next subscription period following the date of the price change. If you do not agree to the new price, you may cancel before the change takes effect.

4. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for any loss of income, revenue, or financial loss arising from the use of, or reliance on, information provided by the Application.
We are not liable for any personal injury or property damage related to your use of the Application.
The Application is provided "as is" without warranties of any kind, whether express or implied.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.

5. Changes to These Terms

We may update these Terms from time to time. We advise you to review these Terms periodically. Continued use of the Application after changes are posted constitutes acceptance of the revised Terms.

6. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Application shall be subject to the exclusive jurisdiction of the courts of England and Wales.
